I suspect that any purchase of WebOS would include a license for all patents associated with it. Otherwise, who would buy it? I agree, I'd like to see HTC hardware designed from the ground up for WebOS.
All these hardware manufacturers jumping around can only help Apple. Almost other significant smartphone maker offers multiple OSes - with the exception of RIM, and Motorola (at #7). Skins be damned, that's no way to build brand loyalty.

I don't mean that they would only need a license for those patents, I mean that they would need to own the patents in order to defend themselves when they are attacked by Apple, Microsoft, et al.

Remember the crank-powered Powerbook (and I don't mean Rush Limbaugh's)? Crazy though that was, it looks like there are some incredible power-saving possibilities out there. This would make it unlikely that Apple would head to ARM for the Macbook Airs. Could you imagine a laptop that would only need to be plugged in if it didn't get enough ambient light every few days? Incredible.
FWIW, I've planning to buy a Classic at some point within the next few months, as my 60 GB iPod 5G has been acting flaky for awhile now. If the Classic is discontinued, I'll just move sooner rather than later. At least in its initial incarnation, iCloud is not a substitute for having everything in one place.
Yeah, my 160GB Classic is basically a permanently-installed accessory in my car.

I use my iPhone in my car now, so that I can keep listening to podcasts and audiobooks from the office. Until a year ago, my iPod 5G resided there.

I just got a new TravelSound by Creative speaker/dock thing about an hour ago for my third generation ipod nano. $6. Pretty nice. I think the Nano and Shuffle are the best iPods going.
